Terms of Use
Effective date: 12 October 2026
Last updated: 12 October 2026
These Terms of Use (“Terms”) are a contract between you and Creptapay (“Creptapay,” “we,” “us,” or “our”) for use of our websites, merchant dashboard, hosted checkout, payment links, APIs, plugins, documentation, and related services (the “Services”).
The Services include, among others:
- creptapay.com
- app.creptapay.com
- pay.creptapay.com (hosted checkout and payment links)
- api.creptapay.com
- docs.creptapay.com
By creating an account, accessing the dashboard, integrating our API or plugin, or paying through checkout, you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of a business, you represent that you have authority to bind that business, and “you” includes that business.
If you do not agree, do not use the Services.
1. What Creptapay is
Creptapay is stablecoin payment infrastructure for businesses. Merchants can:
- Accept stablecoin payments, such as USDC and USDT, on the networks shown at checkout
- Use hosted checkout and shareable payment links
- Create and send invoices, and bill customers on a recurring basis where offered
- Store customer records used for invoicing and billing
- View balances, transactions, and payouts
- Be paid out in USDC to their own wallet, in Nigerian naira (NGN) to a Nigerian bank account, or in Kenyan shillings (KES) to M-Pesa, where those methods are offered for their country
- Use APIs, webhooks, API keys, and plugins (including WooCommerce)
- Invite team members
- Test in a sandbox environment before going live
Creptapay is a payments technology company. It is not a bank, a deposit-taking institution, or a digital asset exchange. Crypto services on Creptapay, including stablecoin conversion and local currency payouts, are provided by a digital asset exchange licensed by Nigeria’s Securities and Exchange Commission (SEC) (our “Licensed Partner”). See Section 7.
Payments are made on public blockchains. We do not take custody of a payer’s personal wallet. Funds paid to a Creptapay deposit address are credited to the merchant’s Creptapay balance according to these Terms and our operational rules.
Creptapay is not a party to the underlying sale of goods or services between a merchant and a payer. The merchant is solely responsible for that relationship, including delivery, any refunds they choose to offer, taxes, and consumer-law duties.
2. Eligibility
You must:
- Be at least 18 years old
- Use the Services for a lawful business, or for a business you are authorised to represent
- Be established in a country where we accept businesses at signup
- Provide accurate registration and verification information
- Not be prohibited from using payment or crypto services under applicable law, including sanctions rules
We may refuse, suspend, or close an account at our discretion, including where business verification is incomplete, inconsistent, or rejected.
3. Accounts
3.1 Registration
You must register with a full name, business name, country, email, and password, then verify your email. You are responsible for all activity under your account, including activity by team members you invite.
Keep your password, two-factor authentication device, and API keys secret. We strongly recommend turning on two-factor authentication. Tell us immediately at [email protected] if you believe your account is compromised.
3.2 Team access
You may invite team members. You are responsible for the roles you grant and for removing access when someone leaves your business.
3.3 Environments
Each business has a sandbox (test mode) and a production (live mode) environment, each with its own keys, balances, and payout account. Sandbox is for testing only: sandbox balances, payments, and keys have no real value. Live payments and payouts require production access after verification.
4. Business verification (KYB)
To process live payments and receive payouts you must complete Know Your Business verification. This typically includes business details, a registration certificate, a government ID, proof of address, and a liveness check.
We may approve, reject, or request resubmission. We may set or change transaction limits while verification is pending or after review. You must keep verification information current.
You grant us a licence to use the documents and recordings you submit to verify your business, meet legal duties, and operate the Services. We may share them with our Licensed Partner and other service providers where needed for those purposes, as described in the Privacy Policy.
5. Payments
5.1 How checkout works
When a payer opens checkout, a payment link, or an invoice:
- We quote an amount in stablecoin based on the merchant’s price and currency
- The quote is held for a limited window (usually 15 minutes) so the payer knows exactly what to send
- We show a deposit address for that payment and the networks it can be paid on
- The payer sends the stablecoin from their own wallet on a supported network
- We monitor the blockchain, mark the payment paid when it meets our confirmation rules, and notify the merchant (for example by webhook and email, depending on settings)
Payers must send the correct asset on a supported network to the exact address shown, before the quote expires. Sending an unsupported asset, using an unsupported network, or paying after expiry can result in delay, extra handling, or loss of funds.
5.2 Prices in other currencies
Where a merchant prices in a currency other than US dollars (for example NGN), we convert it to a stablecoin amount at our quoted rate. The quoted rate may include a margin to cover price movement during the quote window. The payer sees the stablecoin amount before paying.
5.3 Underpayments, overpayments, and stray funds
We detect underpayments and overpayments where we can. An underpaid payment may stay open so the payer can send the rest. Overpayments and other unmatched deposits (“stray funds”) may need manual review. We do not guarantee recovery of misdirected crypto.
5.4 Irreversibility
Blockchain transactions are generally irreversible. Creptapay cannot reverse a confirmed on-chain transfer the way a card network reverses a chargeback. Any refund is a separate transfer that the merchant arranges, subject to available balance and network fees.
5.5 Merchant obligations to payers
You must:
- Describe your goods or services honestly
- Honour the amount and currency you present at checkout
- Handle customer support for your products
- Comply with consumer, tax, and advertising law that applies to you
- Not use Creptapay to collect payment for prohibited activity (Section 9)
A payer’s payment to a Creptapay deposit address for your checkout is payment to you, not a deposit with Creptapay for the payer’s benefit.
6. Balances and payouts
6.1 Balances
Your balance shows the stablecoins credited to your account after confirmed payments, less fees and payouts, separately for sandbox and production. Balances are records of value we owe to you under these Terms; they do not earn interest.
6.2 Payout methods
Depending on your country, you may be paid out to:
- USDC on Base, to a wallet address you control
- NGN, to a Nigerian bank account in your business’s or your own name
- KES, to an M-Pesa number registered to your business or to you
We check that a bank account or M-Pesa number belongs to your business or its owner before saving it, and we may screen wallet addresses against sanctions lists. You are responsible for providing a correct destination. Crypto sent to a wrong address cannot usually be recovered.
6.3 Automatic settlement
Where automatic payouts are on, we pay out your available balance once a day. For NGN and KES payouts, we add up your stablecoin balances at their US dollar value, convert the total to your local currency at the rate available at the time of payout, and show the coins used and the rate on each payout. You can turn automatic payouts off or set a minimum amount in your dashboard.
6.4 Timing
USDC payouts usually arrive within minutes. NGN and KES payouts usually arrive within one to three business days. Network congestion, banking hours, public holidays, and compliance checks can add delay.
6.5 Changing your payout account
To protect you, changing where payouts go may require your two-factor authentication code. When you replace an existing live payout account, live payouts pause for 24 hours and we email the account owner.
6.6 Failed, delayed, and refused payouts
Payouts may be pending, completed, or failed. If a payout fails, the amount is returned to your Creptapay balance. We may delay, refuse, or reverse a payout where we suspect fraud, error, or sanctions exposure, where your balance is insufficient, where verification is incomplete, or where the law or our Licensed Partner requires it.
7. Our Licensed Partner and other providers
Stablecoin conversion and NGN and KES payouts are carried out by our Licensed Partner. By using these features you authorise us to instruct the Licensed Partner on your behalf, and to share the information needed to do so (such as your business details, payout account, and payout amounts). The Licensed Partner may apply its own compliance checks and may decline or delay a transaction.
We also rely on blockchain networks, node and infrastructure providers, banks, mobile money operators, and email providers. We are not responsible for their failures or delays, but we will help you resolve problems where we can.
8. Fees
Unless we agree otherwise in writing:
- Payment fee: a percentage of each payment, currently 1.5%, capped at US$500 per payment. You choose in settings whether your business absorbs the fee or the payer pays it on top.
- Local currency payout fee: 1% on NGN and KES payouts.
- USDC payouts: no Creptapay fee. Blockchain network fees may still apply.
The fees shown in your dashboard or agreed in writing at the time of a payment or payout are the fees that apply. We may change fees with notice, but a quote already shown to a payer keeps its fee.
You are responsible for taxes on your sales. Creptapay fees do not include your VAT, withholding tax, or similar taxes unless we say otherwise in writing.
9. Acceptable use
You may not use the Services to:
- Violate any law, including fraud, money laundering, terrorist financing, or sanctions evasion
- Sell or facilitate illegal goods or services, including (without limitation) illegal drugs, illegal weapons, child sexual abuse material, or stolen data
- Mislead payers about who they are paying or what they will receive
- Interfere with checkout, balances, APIs, or other users
- Probe, scan, or reverse engineer the Services except as allowed by law
- Share API keys publicly or use another user’s account
- Circumvent verification, environment controls, payout holds, or transaction limits
- Collect payments for third parties as a payment aggregator or money-transmission business unless you are licensed to do so and we have agreed in writing
We may freeze balances, reject payments, or close accounts if we reasonably believe this section was breached, and we may report suspicious activity to the authorities where the law requires.
10. APIs, webhooks, and plugins
If you use our API, webhooks, or plugins:
- Keep secret keys confidential, use them only on your server, and rotate them if they leak
- Verify every webhook using the
X-Creptapay-Signatureheader as described in our documentation, and treat webhook payloads as untrusted input - Confirm a payment through the API before fulfilling an order
- Keep your servers and your WooCommerce (or other) store secure and up to date
- Do not use sandbox keys or data in production
We may rate-limit, change, or retire endpoints, with reasonable notice where practicable. Documentation at docs.creptapay.com is provided to help you integrate and is not a separate warranty.
11. Payers (customers)
If you pay a merchant through Creptapay checkout, a payment link, or an invoice:
- You are buying from the merchant, not from Creptapay
- You must send the requested stablecoin, on a supported network, to the address shown, before the quote expires
- We process your name, email, and payment details as described in the Privacy Policy, on behalf of the merchant and to run the payment
- Questions or disputes about the product or service must be raised with the merchant
- Creptapay cannot pull back an on-chain payment once it is confirmed
12. Intellectual property
Creptapay and its licensors own the Services, including software, logos, design, and documentation. We grant you a limited, non-exclusive, non-transferable licence to use the Services as offered, for your business, while your account is in good standing.
You keep the rights in your content (business name, logo, invoices, customer lists). You grant us a licence to host and display that content as needed to run checkout, payment links, invoices, and the dashboard.
You may not copy, scrape, or resell the Services except as we allow in writing.
13. Availability and changes
We aim to keep the Services available but do not guarantee uninterrupted, error-free operation. Blockchains, node providers, our Licensed Partner, banks, mobile money operators, and email providers can fail or delay independently of Creptapay.
We may add, change, or remove features, supported assets, networks, countries, or payout methods. Where a change is material to live merchants, we will give reasonable notice in the dashboard, by email, or in our documentation, unless we must act immediately for security or legal reasons.
14. Suspension and closure
We may suspend or close your account, hold payouts, or disable API keys if:
- You breach these Terms
- Verification is rejected, incomplete, or later found to be false
- The law, a regulator, or our Licensed Partner requires it
- We reasonably suspect fraud, sanctions exposure, or risk to other users
- Your account is inactive for an extended period
You may close your account by contacting [email protected]. We will pay out any balance we can lawfully send, after settling fees and completing pending payments. We keep records as required by law and as described in the Privacy Policy.
15. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREPTAPAY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- Exchange rates will match any particular market rate outside a quote window or at the time of payout
- A blockchain, bank, mobile money operator, or third-party wallet will process a transfer on any schedule
- A stablecoin will keep its peg or remain supported by its issuer
- A merchant will deliver goods or services
- Sandbox behaviour will always match production
You accept the technical and market risks of using stablecoins and blockchains.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- CREPTAPAY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY
- CREPTAPAY IS NOT LIABLE FOR LOSSES CAUSED BY WRONG WALLET ADDRESSES, WRONG OR UNSUPPORTED NETWORKS OR ASSETS, LATE OR FAILED BLOCKCHAIN TRANSFERS, BANK OR MOBILE MONEY DELAYS, MERCHANT–PAYER DISPUTES, OR UNAUTHORISED ACCESS RESULTING FROM YOUR FAILURE TO PROTECT YOUR CREDENTIALS
- CREPTAPAY’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SERVICES IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE FEES YOU PAID TO CREPTAPAY IN THAT PERIOD
Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud, or for death or personal injury caused by negligence.
17. Indemnity
You will indemnify and hold harmless Creptapay and its officers, employees, and contractors from claims, losses, and reasonable legal fees arising from:
- Your use of the Services
- Your goods, services, invoices, or customer relationships
- Your breach of these Terms or of law
- Content or data you submit, including verification materials and customer records
- A claim by a payer or third party relating to a payment you initiated or received
18. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules.
The courts of Nigeria have exclusive jurisdiction over disputes, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or the security of the Services.
Before filing a claim, you agree to email [email protected] and try in good faith to resolve the dispute for 30 days.
19. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement for the Services, unless we sign a separate written contract with you (for example an order form).
- Order of precedence. A signed order form controls over these Terms for the conflicting point only.
- Severability. If a clause is unenforceable, the rest remains in effect.
- No waiver. Failure to enforce a right is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, sale, or reorganisation.
- Notices. We may notify you by email, dashboard notice, or on the website. You may notify us at [email protected].
- Language. These Terms are in English. Translations, if any, are for convenience only.
20. Changes to these Terms
We may update these Terms. We will change the “Last updated” date and, for material changes, notify merchants by email or in the dashboard before they take effect. If you keep using the Services after the new Terms take effect, you accept them. If you do not agree, stop using the Services and ask us to close your account.
